OVERVIEW
Welcome to Chic & Clicks. The terms “we”, “us” and “our” refer to CHICK AND CLICKS E.E. (hereinafter “Chic & Clicks”). Chic & Clicks operates this online store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the “Services”).
Chic & Clicks is supported by Shopify, which enables us to provide the Services to you.
The following terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and obligations when you use the Services.
Please read these Terms carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability, to the extent permitted by law.
When you visit, interact with, or use our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms and/or the Privacy Policy, you should not use or access our Services.
SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms, you confirm that you have reached the required age in your country/region of residence and that you have the legal capacity to enter into a binding agreement.
To use the Services, including browsing our store or purchasing products, you may be asked to provide information such as your email address, billing/payment details, and shipping information. You represent and warrant that all information you provide is accurate, up to date, and complete, and that you have the right to provide such information.
You are solely responsible for keeping your account credentials secure and for all activity that occurs under your account. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 – OUR PRODUCTS
We have made every effort to provide accurate depictions and descriptions of our products. However, colors/shades may differ from what you see on your screen depending on your device and settings.
Some of our products are made from natural materials (e.g., genuine leather/suede). As natural materials, they may show minor variations in texture/shade or develop a “patina” over time, which is a characteristic of the material and not a defect.
Product descriptions, availability, and specifications may change at any time without notice, at our reasonable discretion. We reserve the right to discontinue any product at any time or to limit the quantities offered to any person, geographic region, or jurisdiction, where permitted.
SECTION 3 – ORDERS
When you place an order, you submit an offer to purchase. We reserve the right to accept or reject your order, in accordance with applicable law and in good faith, for reasons such as (indicatively) lack of availability, pricing/description errors, inability to process payment, or suspected fraud.
An order is considered accepted when we send you a confirmation of acceptance/completion (e.g., an order confirmation/shipping confirmation email). Cancellation may not be possible after processing/shipment. This does not affect your statutory rights as a consumer (e.g., the right of withdrawal).
If we do not accept, change, or cancel an order, we will attempt to notify you via the email and/or phone number you provided.
Your purchases are subject to return or exchange in accordance with our Shipping Policy and our Return & Refund Policy.
You represent and warrant that your purchases are for personal use and not for commercial resale.
SECTION 4 – PRICES, PAYMENTS AND CHARGES
Prices, discounts, and offers may change without notice. The price charged is the price in effect at the time the order is placed and is shown at checkout and/or in the confirmation email.
Prices are displayed in euros (€) and include applicable VAT where relevant. Any shipping costs or other charges are shown at checkout before you complete your order.
In case of an obvious error (including typographical or technical errors in price/availability), we reserve the right to correct the error and, if necessary, cancel the order and refund any amounts paid.
You agree to provide current, complete, and accurate purchase/payment/account information for all purchases, so we can complete transactions and contact you when needed.
SECTION 5 – SHIPPING AND DELIVERY
Estimated delivery times are provided in our Shipping Policy and our Return & Refund Policy, and are indicative. We are not responsible for delays due to events beyond our control (e.g., courier delays, unforeseen circumstances, force majeure).
Transfer of risk (EU/Consumers): The risk of loss or damage to the products transfers to you when you, or a person designated by you, acquires physical possession of the products. If you choose your own carrier that is not offered by us, the risk transfers upon delivery of the products to that carrier.
SECTION 6 – INTELLECTUAL PROPERTY
Our Services, including (indicatively) all trademarks, brand names, text, images, graphics, video, audio, and their design/layout, belong to Chic & Clicks or its licensors and are protected by the intellectual property laws of Greece, the European Union, and applicable international provisions.
These Terms allow you to use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, or exploit any material from the Services without our prior written consent.
The names, logos, product/service names, designs, and slogans of Chic & Clicks are our trademarks or those of our licensors. You must not use them without our prior written permission. Shopify and its related marks belong to Shopify. All other marks belong to their respective owners.
SECTION 7 – OPTIONAL TOOLS
We may provide access to third-party tools/features. You acknowledge that they are provided “as is” and “as available” without warranties from us and that your use is at your own risk. Third-party terms may apply.
SECTION 8 – THIRD-PARTY LINKS
The Services may contain links to third-party websites. We are not responsible for third-party content/policies. Access is at your own risk.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
Chic and Clicks is supported by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Chic and Clicks. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and Chic and Clicks, including any injury, damage, or loss resulting from purchased products and services.
You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Chic and Clicks.
SECTION 10 – PRIVACY POLICY
Personal information we collect through the Services is subject to our Shipping Policy. Certain information may also be subject to Shopify’s Privacy Policy. By using the Services, you confirm that you have read the relevant privacy policies.
SECTION 11 – FEEDBACK
If you submit ideas, comments, reviews, or suggestions (“Feedback”), you grant us a non-exclusive, worldwide, royalty-free license to use/reproduce/modify/publish/display your Feedback for operating and promoting the Services, to the extent permitted by law. You represent that you have the necessary rights to submit the Feedback.
SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS
There may be errors or omissions related to descriptions, prices, promotions, shipping charges, delivery times, and availability. We reserve the right to correct such information and, where necessary, cancel orders.
SECTION 13 – PROHIBITED USES
You may use the Services only for lawful purposes. Prohibited uses include, without limitation, use for unlawful acts, infringement of third-party rights, harassment, dissemination of malicious code, scraping, or bypassing security mechanisms. We reserve the right to restrict/terminate access in case of violation, in accordance with the law.
SECTION 14 – TERMINATION / ACCESS END
We may restrict or terminate your access to the Services if you materially breach these Terms or for security/legal compliance reasons. You remain responsible for any amounts due up to the termination date.
SECTION 15 – CONSUMER RIGHTS
Nothing in these Terms limits or excludes any rights that cannot be excluded under applicable consumer protection law.
SECTION 16 – RIGHT OF WITHDRAWAL, RETURNS & EXCHANGES
If you are acting as a consumer, you have the right to withdraw from a distance contract within fourteen (14) calendar days of delivery, in accordance with applicable law. The terms, process, any exceptions, and the details of returns/exchanges/refunds are described in our Shipping Policy and our Return & Refund Policy. In case of conflict, mandatory consumer protection provisions prevail.
SECTION 17 – LEGAL WARRANTY & DEFECTIVE PRODUCTS
The seller is liable to the consumer for any lack of conformity of goods that exists at the time of delivery and becomes apparent within at least two (2) years thereafter, in accordance with applicable law. In case of defect/non-conformity, the consumer is entitled to the legal remedies (indicatively repair or replacement or, where provided, price reduction or withdrawal), as provided by law.
SECTION 18 – DISCLAIMER OF WARRANTIES
The Services are provided “as is” and “as available”, to the extent permitted by law. We do not warrant that your use of the Services will be uninterrupted, timely, secure, or error-free. These disclaimers do not apply where prohibited by mandatory consumer protection provisions.
SECTION 19 – LIMITATION OF LIABILITY
To the maximum extent permitted by law, Chic & Clicks is not liable for indirect, incidental, special, or consequential damages. Nothing in these Terms limits our liability where such limitation/exclusion is prohibited by applicable law (especially in relation to consumer rights).
SECTION 20 – INDEMNIFICATION
You agree to indemnify and hold harmless Chic & Clicks and its partners/providers from third-party claims arising from unlawful use of the Services or your breach of these Terms, to the extent permitted by law.
SECTION 21 – SEVERABILITY
If any provision is found invalid or unenforceable, the remaining provisions will remain in effect.
SECTION 22 – ENTIRE AGREEMENT
These Terms, together with the policies referenced (Privacy Policy, Shipping Policy, Returns/Refunds, etc.), constitute the entire agreement between you and us.
SECTION 23 – ASSIGNMENT
You may not assign your rights/obligations without our written consent. We may assign/transfer our rights and obligations in accordance with the law.
SECTION 24 – GOVERNING LAW & JURISDICTION
These Terms are governed by Greek law. Any disputes shall be subject to the courts of Athens, without prejudice to any mandatory consumer protection provisions that apply in your place of residence.
SECTION 25 – CHANGES TO THESE TERMS
We reserve the right to update or modify these Terms by publishing the new version on the website. Continued use of the Services after changes are published constitutes acceptance of those changes, to the extent permitted by law.
